Terms of Service

1. Acceptance of Terms and Eligibility

These Terms of Service constitute a binding legal agreement between you and [XENIA LEGAL ENTITY NAME], the operator of XENIA, accessible at xenia.studio. By creating an account, accessing, or using XENIA in any way, you accept and agree to be bound by these Terms of Service and by the practices described in the Privacy Policy. If you do not agree, you must not access or use XENIA.

XENIA is a fantasy adult social network intended exclusively for verified adults who are 18 years of age or older. By using XENIA, you represent and warrant that you are at least 18 years of age, that you have the legal capacity to enter into this agreement, and that your use of XENIA does not violate any law applicable to you. Access by any person under the age of 18 is strictly prohibited. XENIA is not available in any jurisdiction where adult content or the services described in these Terms of Service are unlawful, and you are responsible for ensuring that your access is lawful in your location.

You further represent that you have never been convicted of, and are not required to register for, any offense involving sexual misconduct, the sexual exploitation of a minor, or human trafficking, and that you are not barred from receiving services under the laws of any applicable jurisdiction.

1.1 Jurisdictional Availability and Age-Verification Laws

XENIA contains content restricted to adults that certain United States states classify as material from which minors must be shielded by verified age assurance. Where XENIA determines that a viewer is located in a jurisdiction that requires age or identity verification as a condition of accessing adult content, XENIA conditions access on completion of that verification, which a viewer may satisfy by creating an account through full government ID verification, or XENIA declines to make adult content available in that jurisdiction. You represent and warrant that you are accessing XENIA from a jurisdiction in which your access is lawful and that you have completed any age verification required by the law of your location. You agree not to use any virtual private network, proxy, or other means to circumvent geographic or age-verification controls, and you accept sole responsibility for any access undertaken in violation of the law of your jurisdiction.

1.2 Sanctions and Prohibited Jurisdictions

You represent and warrant that you are not, and are not acting on behalf of, any person who is named on the United States Treasury Department Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons List or any other sanctions list maintained by the United States, the United Nations, the European Union, or the United Kingdom, or who is owned or controlled by any such person, and that you are not located, organized, or resident in any country or territory that is the target of comprehensive United States sanctions, which presently include Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine. You agree not to use XENIA from any such jurisdiction, on behalf of any sanctioned person, or in any transaction with a wallet you know or have reason to believe is associated with a sanctioned person. XENIA may decline to make its software available to, and may block, any wallet address or jurisdiction in order to comply with applicable sanctions laws.

2. Description of the Service

XENIA is a platform on which verified adult creators publish images and short looping animations that have been transformed by an AI anime augmentation and filter created locally within the XENIA Studio desktop application. The augmentation runs on the device of the creator. The original, un-filtered photographs and videos never leave the machine of the creator. XENIA stores and serves only the filtered output. XENIA does not receive, process, store, or have any access to the original source media.

Stored content is encrypted at rest using AES-256-GCM. Each creator is issued a subdomain in the form username.xenia.studio together with a profile page through which followers may view content, send tips, unlock images, and purchase access to off-platform contact handles.

Creating a profile is free in the sense that XENIA charges no subscription, listing, or membership fee. XENIA receives only the platform share, currently seven percent, automatically retained by the on-chain program from each tip, image unlock, and DM reveal. Additional detail regarding the operation of XENIA is available in the documentation.

The XENIA augmentation is designed to substantially alter the facial appearance of a creator to reduce the likelihood of identification. It is an aesthetic and privacy-enhancing tool, not a guarantee of anonymity. XENIA does not represent or warrant that any augmentation will prevent identification in all circumstances. Factors outside the augmentation, including distinguishing marks, tattoos, voice, location, background details, metadata, third-party re-identification techniques, and the conduct of a creator off the platform, may allow a person to be recognized. Creators should not rely on the augmentation as a sole means of protecting their identity.

User-generated content; no editorial control. XENIA is an interactive computer service that hosts and transmits content created, selected, and published by independent third-party creators. XENIA does not create, author, commission, direct, or pre-screen creator content and does not adopt or endorse it. Any removal, ranking, filtering, or refusal of content by XENIA is undertaken as a provider of an interactive computer service and as a good-faith effort to restrict objectionable material under 47 U.S.C. Section 230(c), and no such action shall be construed as XENIA authoring, ratifying, or assuming responsibility for any creator content.

3. Accounts, Age Verification, and Security

3.1 Account Creation and Verification

To create an account you must provide a valid email address and complete email verification. You must also complete full identity verification through Yoti, performed by government identity document scan or the Yoti application, which establishes both that you are at least 18 years of age and that the person is you. Until both email verification and identity verification are complete, account functionality is restricted. Browsing public content requires no account and no verification.

You agree that the information you provide is accurate, current, and complete, and that you will keep it accurate, current, and complete. XENIA reserves the right to refuse, suspend, or revoke verification, and to refuse service, at its sole discretion.

3.2 Your XENIA Wallet

XENIA generates a non-custodial Solana wallet for your account in your browser at signup. XENIA does not support importing an external wallet, and your account is permanently bound to the single wallet address generated for it; you can only ever unlock and operate that address. The private key and seed are generated on, and never leave, your device. XENIA stores only your public wallet address, which is public information and confers no ability to access or spend your funds. You are solely responsible for the security of your wallet, your private key, and your 24-word recovery phrase. XENIA never has access to your private key or seed and cannot recover, reset, freeze, move, or restore access to your wallet. Your 24-word recovery phrase is the only backup; if you lose it and every device holding your wallet, the wallet and its funds are unrecoverable by anyone, including XENIA.

3.3 Account Security

You are responsible for all activity that occurs under your account. You must maintain the confidentiality of your login credentials and notify XENIA promptly of any unauthorized use. XENIA is not liable for any loss arising from unauthorized use of your account or your wallet.

3.4 Biometric Consent

Creator verification involves the processing of biometric identifiers and biometric information as described in the Privacy Policy. You acknowledge that XENIA collects and uses this data only after your separate, express written consent, solely to verify identity and presence, and subject to the retention and destruction schedule set out in the Privacy Policy. If you do not provide biometric consent, you may not complete creator verification.

3.5 Accounts Are Personal and Non-Transferable

Accounts are personal and non-transferable. You must not share, sell, lend, or permit any other person to use your verified account. Other persons may appear in your content. The XENIA Studio application screens every detected face in your source media for apparent-adult age before any render and rejects content where any face is estimated to be under age. Full government ID verification is required of the account holder; it is not required of every other person depicted, which is not practicable for group content. You must hold, and produce on lawful demand, documented consent and proof that every person depicted was at least 18, as set out in Section 4.3. Each verified identity may hold at most one account, and an account that has been banned may not be re-registered; XENIA may refuse a signup that matches the identity of an existing or banned account. XENIA may require re-verification at any time. Attempting to circumvent, falsify, or transfer verification, or to create more than one account, is grounds for immediate termination and may be reported to authorities. Identity and age verification performed through Yoti is a risk-reduction control and is not a warranty by XENIA that any creator is an adult; the representations and warranties of each creator are independent of, and survive, any verification result.

4. User Content and License Grant

4.1 Ownership

As a creator, you retain all ownership rights you hold in the content you publish to XENIA. These Terms of Service do not transfer ownership of your content to XENIA.

4.2 License to XENIA

By publishing content to XENIA, you grant XENIA a limited, worldwide, non-exclusive, royalty-free, sublicensable license to host, store, encrypt, cache, transmit, and display at your direction that content, including the creation of previews, thumbnails, and blurred or partially obscured representations, solely to the extent necessary to operate, secure, and provide the Service. XENIA acts as a passive conduit and host for content that creators choose to make available and does not select, curate, or editorially distribute creator content. This license exists only to operate the Service and ends, with respect to active display, when you delete the content or your account, subject to reasonable operational and backup retention and to any retention required by law.

4.3 Creator Warranties Regarding Content

You are solely and fully responsible for every item of content you publish, including its legality, the consent of every person depicted, and its compliance with all applicable law. XENIA is a host and does not pre-screen content. For every item of content you publish, you represent and warrant that:

• You own the content or otherwise hold all rights, licenses, and permissions necessary to publish it and to grant the license set out above.
• You have obtained and retain, for every person depicted in the source media, a written, signed consent and release that identifies the person by legal name, establishes by government-issued photographic identification that the person was at least 18 at the time the source media was created, expressly consents to the creation of the source media, to its transformation by the XENIA augmentation, and to publication of the transformed output on XENIA, and grants the rights of publicity and likeness necessary for that transformation and publication. You will produce these records on lawful demand.
• Other persons may appear in your content without holding a XENIA account. Where any person other than you appears in the source media, you hold and will produce, for each such person, the documented consent and proof of age described above. The verified-likeness watermark attests only that your own verified likeness is present and makes no representation about any other person.
• The content is not legally obscene and does not violate 18 U.S.C. Sections 1460 to 1466 or any analogous state law, and you have independently determined that its publication is lawful in every jurisdiction in which you offer it.
• The content is not a non-consensual intimate image or digital forgery of any person, and your publication of it does not violate the TAKE IT DOWN Act, 15 U.S.C. Section 6851, or any state law governing non-consensual intimate imagery or AI-generated intimate imagery, including California Civil Code Sections 1708.85 and 1708.86, Texas Civil Practice and Remedies Code Section 98B and Texas Penal Code Section 21.165, Virginia Code Section 18.2-386.2, and New York Civil Rights Law Sections 52-b and 52-c.
• The content does not, expressly or by implication, falsely depict any identifiable person as having engaged in any sexual or other conduct, and does not defame, place in a false light, or violate the right of publicity or right of privacy of any person.
• The content, including the filtered output, does not infringe the intellectual property rights, privacy rights, publicity rights, or any other rights of any person.
• You are able to produce, upon lawful request, records sufficient to satisfy applicable record-keeping obligations, as further described at 2257.

You acknowledge that XENIA stores and serves only AI-filtered output and does not receive the underlying source media, and that responsibility for the lawfulness, accuracy, and consent associated with that source media rests entirely with you.

5. Content Standards and Prohibited Uses

The following content is strictly prohibited on XENIA, without exception. You must not create, upload, publish, link to, solicit, or distribute through XENIA any content that depicts, promotes, or facilitates:

• Any minor, any person under the age of 18, or any depiction that is, appears to be, is represented to be, is captioned or tagged as, or is styled or transformed to resemble a person under the age of 18, whether the depiction is real, fictional, animated, AI-generated, or the output of the XENIA augmentation. This prohibition applies to the transformed output itself, independent of the verified age of the source creator. Prohibited youthful-appearance cues include, without limitation, school or childhood settings, child or adolescent clothing, props, or framing, and any caption, tag, username, or styling that references childhood, adolescence, or a person under 18. XENIA prohibits any visual depiction described in 18 U.S.C. Sections 1466A and 2252A, including any depiction that is obscene or that is indistinguishable from, or appears to be, a minor engaging in sexually explicit conduct, regardless of how it was produced.
• Any use of the XENIA Studio styling or theme controls, or any caption or tag, to make any depicted person appear younger than the person's true age or to appear to be under 18.
• Any non-consensual content, including content depicting any person who has not given verified, documented consent, and any content created, published, or distributed without such consent.
• Bestiality or any sexual content involving animals.
• Incest or sexual content depicting family relationships of that nature.
• Violence, abuse, torture, or the coercive use of weapons.
• Human trafficking, sexual exploitation, or any form of coercion.
• Any non-consensual intimate image or digital forgery, meaning any intimate or sexual depiction of an identifiable person, whether authentic, altered, face-swapped, AI-generated, or AI-transformed, published without that person's documented consent. Anime or other stylization does not cure the absence of consent.
• Any content depicting, naming, or evoking the likeness, name, voice, or persona of any identifiable real person other than a consenting verified creator, including any public figure, celebrity, or private individual, in a manner that would violate that person's right of publicity, place that person in a false light, or defame that person.
• Any content that is legally obscene under the test set out in Miller v. California. The anime or animated styling of content does not exempt that content from obscenity law.
• Soliciting, offering, advertising, arranging, or paying for prostitution, escorting, sexual services, or any in-person commercial sexual activity, whether on the platform or through any off-platform handle obtained through XENIA.
• Uploading any content depicting any person who has not provided the documented consent and release described in Section 4.3, including any former partner, any unaware third party, or any person whose likeness was used without a release.
• Any content that is illegal in the jurisdiction applicable to you or to the person depicted.

You must also not use XENIA to harass, threaten, defame, dox, or impersonate any person; to distribute malware or attempt to compromise the security or integrity of the Service; to circumvent age verification, payment, or access controls; to scrape, harvest, or republish content without authorization; or to engage in any unlawful activity. XENIA cooperates with law enforcement and reports apparent child sexual abuse material and other serious crimes to the appropriate authorities.

6. Payments, Wallet, and No Custody

6.1 No Money Transmission

XENIA provides software that enables users to construct and broadcast their own peer-to-peer transactions on the Solana network. At no point does XENIA accept, hold, control, or transmit fiat currency or digital assets on behalf of any user. Every transaction is initiated, signed, and authorized solely by the user from a wallet the user controls, and settles directly between user wallets through an autonomous on-chain program. XENIA never takes custody or control of value, never has the ability to move, freeze, or reverse user funds, and does not act as a money transmitter, money services business, custodian, exchanger, administrator, escrow agent, or financial intermediary. The platform fee is paid by the on-chain program directly from the authorized instruction of the transacting user and is consideration for use of the XENIA software; it is not a fee for transmitting value on behalf of any person.

6.2 Revenue Split and What "Free" Means

When a transaction is executed, the on-chain program splits the funds in a single atomic instruction, directing 93 percent to the creator and 7 percent to the platform. This split occurs on-chain as part of one transaction and applies to every tip, image unlock, and DM reveal. The supported currencies are SOL and USDT as an SPL token. XENIA charges no subscription, listing, or membership fee; use of XENIA is free only in the sense that no separate fee is charged, and the seven percent platform share applies to every transaction. The split applies to the on-chain transaction amount at settlement and does not account for network gas fees or for any fees, spreads, or costs charged by third-party fiat on-ramp providers or wallets, which may reduce the net amount a creator realizes.

6.3 Finality and Refunds

On-chain transactions are public, permanent, and irreversible. Because settlement is final on the Solana network, XENIA is technically unable to reverse or refund a completed transaction, and all sales are final. Nothing in this section limits any non-waivable right or remedy you may have under applicable consumer-protection law. You acknowledge and accept this finality before authorizing any transaction.

6.4 Gas, Network, and Pricing Risk

Network gas fees required to execute transactions on Solana are the responsibility of the user. The value of SOL and USDT may fluctuate, and you bear all risk associated with the use of digital assets, including price volatility, network congestion, failed transactions, and loss of access to your wallet.

6.5 Taxes

You are solely responsible for determining, reporting, and paying any taxes that apply to amounts you send or receive through XENIA. XENIA does not withhold, collect, or remit taxes on your behalf and provides no tax advice.

6.6 Fiat On-Ramp Providers

If you acquire digital assets through a third-party fiat on-ramp provider, that transaction is governed by the terms of that provider. XENIA is not a party to it and bears no responsibility for it.

6.7 Third-Party Controls on Your Funds

The non-custodial design of XENIA means XENIA itself never holds, freezes, reverses, or withdraws your funds. It does not mean your funds are beyond all third-party action. Digital assets may be subject to controls outside the involvement of XENIA, including network-level or token-issuer controls. For example, the issuer of a stablecoin such as USDT may freeze token balances, and your wallet may be subject to sanctions or legal process or to loss resulting from compromise of your own keys. XENIA makes no representation regarding the conduct of any third party, token issuer, validator, or authority with respect to your wallet or funds.

6.8 User Responsibility for Compliance, Taxes, and AML

You are solely responsible for compliance with all laws applicable to your transactions, including tax reporting and any anti-money-laundering, counter-terrorist-financing, and sanctions obligations applicable to you. You represent that the funds you transact are lawfully derived, that you are not transacting on behalf of any undisclosed third party, and that your use of XENIA does not further any unlawful purpose.

7. DM Reveals and Off-Platform Conduct

The DM reveal feature permits a creator to disclose a contact handle the creator has chosen to share, which may include Telegram, Discord, Keybase, SMS, or email, so that a user may communicate with the creator. It is provided solely to enable lawful, voluntary social and fan communication. The platform fee retained on a DM reveal is consideration for the technical disclosure function only; it is not a fee for, commission on, or share of any off-platform transaction, of which XENIA has no knowledge and in which XENIA is not a participant or beneficiary.

No solicitation of unlawful services. The DM reveal feature must not be used to offer, solicit, arrange, advertise, or pay for any commercial sexual activity, escort service, prostitution, in-person meeting for sexual services, or any other unlawful service, whether on or off the platform. Purchasing a DM reveal grants access to a contact handle only; it confers no right to, and no expectation of, any meeting, service, or sexual conduct of any kind. XENIA prohibits any use of the platform to promote or facilitate prostitution within the meaning of 18 U.S.C. Section 2421A or any analogous state law, does not broker, arrange, or facilitate any meeting, service, or transaction between users, and may permanently ban and report to law enforcement any user who violates this section.

XENIA does not proxy, transmit, store, monitor, moderate, or read any off-platform conversation. XENIA has no knowledge of and no control over off-platform conduct, content, or arrangements. Any interaction that takes place off-platform is solely between the participating users and is undertaken at their own risk. You agree that XENIA is not responsible or liable for any off-platform communication, transaction, promise, or harm, and that a DM reveal grants access to a contact handle only and is not a guarantee of any response, service, content, or outcome from the creator.

8. Reporting, Moderation, Suspension, and Termination

8.1 Reporting

Viewers may report content that they believe violates these Terms of Service. Reports are reviewed by the owner of the platform. Content remains inert until reviewed; no automatic action is taken against content or accounts on the basis of a report alone. Action is taken only after the owner of the platform reviews the report.

8.2 Moderation Actions

Upon review, the owner of the platform may, at sole discretion, remove content, restrict features, freeze an account, or ban an account. XENIA may take these actions with or without notice where it deems them necessary, including to comply with law or to address prohibited content. XENIA is under no obligation to monitor content proactively but reserves the right to do so.

8.3 Effect on Funds

Because XENIA is non-custodial, freezing or banning an account affects only access to the Service and the profile of the user. It does not and cannot affect funds already settled on-chain, which remain in the non-custodial wallet of the user and outside the control of XENIA.

8.4 Termination by You

You may stop using XENIA and request deletion of your account at any time. Termination does not entitle you to any refund and does not reverse any completed on-chain transaction.

8.5 Mandatory Reporting and Preservation

XENIA complies with 18 U.S.C. Section 2258A. Upon obtaining actual knowledge of any apparent child sexual abuse material, XENIA reports it to the CyberTipline of the National Center for Missing and Exploited Children, preserves the reported material and associated data for at least 90 days in accordance with 18 U.S.C. Section 2258A(h), removes it from public access, and cooperates with law enforcement. Material subject to a report, a preservation request, or a legal hold is preserved and is excluded from deletion-on-request for as long as required by law.

8.6 Freeze Means Account Access Only

Any reference in the XENIA interface or marketing to XENIA being unable to freeze, reverse, or control funds refers to user funds on-chain, which XENIA genuinely cannot touch. It does not mean XENIA cannot restrict, suspend, freeze, or terminate a user's account or access to the platform, which XENIA may do under this Section 8.

9. XENIA Intellectual Property

The XENIA platform, including the XENIA Studio desktop application, the AI anime augmentation and filter, the on-chain program, the software, design, user interface, brand, name, logos, and all related intellectual property, are owned by [XENIA LEGAL ENTITY NAME] or its licensors and are protected by applicable law. Except for the rights expressly granted to you in these Terms of Service, no right, title, or interest in or to XENIA is transferred to you.

You must not copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to derive the source code of any part of XENIA, except to the extent that such restriction is prohibited by applicable law. The license you grant XENIA in your content does not diminish the rights of XENIA in its own intellectual property.

10. Third-Party Services

XENIA relies on and integrates with third-party services that are operated by parties independent of XENIA, including:

• Yoti, which provides age and identity verification. Your use of Yoti is subject to the terms and privacy practices of Yoti.
• Fiat on-ramp providers, which may be used to acquire digital assets and are subject to their own terms.
• The Solana network, a public, decentralized blockchain on which all transactions settle. XENIA does not operate or control the Solana network.

XENIA does not control these third-party services and is not responsible for their availability, accuracy, security, or conduct. Your use of any third-party service is at your own risk and subject to the terms of that third party. The integration of a third-party service does not constitute an endorsement by XENIA.

11. Disclaimers

XENIA is provided on an AS IS and AS AVAILABLE basis, without warranty of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, XENIA disclaims all warranties, including any implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade.

XENIA does not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, that content will be accurate or lawful, that any creator will provide any content or response, or that the encryption, age verification, the augmentation, or any other safeguard will be infallible, including that the augmentation will render any creator unidentifiable. XENIA does not warrant the conduct of any user, the value or behavior of any digital asset, or the operation of the Solana network or any third-party service. You assume all risk arising from your use of XENIA, from your use of digital assets, and from any interaction with any other user, whether on-platform or off-platform.

12. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will [XENIA LEGAL ENTITY NAME], its affiliates, or its officers, directors, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, digital assets, or other intangible losses, arising out of or relating to your use of or inability to use XENIA, whether based on warranty, contract, tort, statute, or any other legal theory, and whether or not XENIA has been advised of the possibility of such damages.

Without limiting the foregoing, XENIA has no liability for any loss of funds, loss of private keys, irreversible or failed on-chain transactions, gas fees, fluctuations in the value of digital assets, any conduct of any user, or any off-platform communication or transaction.

To the fullest extent permitted by applicable law, the total aggregate liability of XENIA arising out of or relating to these Terms of Service or your use of XENIA will not exceed the greater of the total platform share of XENIA actually received from transactions attributable to your account in the three months preceding the event giving rise to the claim, or one hundred United States dollars. Some jurisdictions do not allow certain limitations, and in such jurisdictions the liability of XENIA is limited to the greatest extent permitted by law.

Nothing in this section limits liability that cannot be limited or excluded under applicable law, or a party's own willful misconduct. If any limitation in this section is held unenforceable as to any claim, it remains in full force as to all other claims.

13. Indemnification

You agree to defend, indemnify, and hold harmless [XENIA LEGAL ENTITY NAME], its affiliates, and its officers, directors, employees, contractors, and agents from and against any claim, demand, action, liability, damage, loss, cost, or expense, including reasonable legal fees, arising out of or relating to: your content, including any claim that it lacks consent or depicts a person under the age of 18; your breach of these Terms of Service or of any warranty you make; your violation of any law or of the rights of any person; your use of XENIA; any on-chain transaction you authorize; any off-platform interaction or communication in which you participate; and any claim for defamation, false light, violation of the right of publicity or right of privacy, violation of the TAKE IT DOWN Act or any state non-consensual-imagery or deepfake statute, or any claim that the content depicts any person without consent. This indemnification obligation survives the termination of your account and of these Terms of Service. XENIA reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with the defense of XENIA.

14. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of [GOVERNING JURISDICTION], without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms of Service or to XENIA will be resolved exclusively in the courts located in [GOVERNING JURISDICTION], and you consent to the personal jurisdiction of those courts, except where binding arbitration or another forum is required by applicable law.

To the fullest extent permitted by applicable law, you agree that any claim will be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Any claim arising out of or relating to XENIA must be commenced within one year after the claim arose, failing which it is permanently barred, except where a longer period is required by applicable law. These dispute-resolution provisions bind only the parties to these Terms of Service and do not purport to limit the rights of any non-party, including any person about whom content was published without consent.

15. Changes to These Terms
